Terms of service
These terms govern the use of Luke by the restaurants that subscribe to the service and by the people who use it. The commercial proposal or the contract signed with each customer prevails over this text wherever they differ.

The service
Luke is a staff of agents that runs a restaurant's processes on WhatsApp and Telegram, with a web workspace for supervision and integrations with the business's systems. It is provided by Servicios Tecnológicos Cotalker SpA.
Acceptance
By subscribing to Luke, or by using it as part of the team of a restaurant that subscribed, you accept these terms and the privacy policy.
Your account and your team
- The restaurant manages who has access, with which role and at which locations, and is responsible for how its team uses the service.
- Dashboard access and integration credentials belong to the person or to the restaurant; they are not to be shared with third parties.
- If you suspect unauthorized access, let us know immediately.
Permitted use
Luke is for running your business. You may not use it to send unsolicited messages, for illegal or offensive content, to access systems or data that are not yours, or to breach WhatsApp's or Telegram's policies.
We may suspend any use that puts the service or third parties at risk, and we will notify you.
Your data
Your operational data is yours. You grant us the permission needed to process it and deliver the service, as described in the privacy policy. When the service ends, you can export it.
Agents, automation and human control
The agents act according to the processes and rules configured for your restaurant. You decide where a human approval goes.
Reading documents and photos and the agents' replies rely on artificial intelligence and may contain errors. Review anything critical to your business before acting on it. Luke does not make commercial, employment or legal decisions for you.
Integrations and third-party systems
Connecting your point of sale, ERP or other systems requires that you have the right to do so and that those systems allow it. How those connections work depends on the availability of, and changes to, systems we do not control.
Major integrations are quoted separately, after a technical validation.
Plans and payment
The service is subscribed per location, according to the plan agreed in the commercial proposal. The plan is determined by the volume of agent activity, not by features.
A fair use policy applies: reaching the plan's limit does not interrupt the service or generate variable charges; sustained use above the plan opens a conversation about changing plans.
Prices, currency, taxes and payment terms are set out in the proposal.
Term and termination
The service is monthly unless the proposal states otherwise, with no lock-in. Either party may terminate it with 30 days' notice.
When the service ends, you have 30 days to export your data; after that we delete it, except for what the law requires us to keep.
Availability and support
We work to keep Luke continuously available, with scheduled maintenance announced in advance. Support is provided through the channels agreed in the proposal.
Messaging channels depend on WhatsApp and Telegram, which we do not control.
Intellectual property
Luke, its software, its agents and its brand belong to Cotalker. You have the right to use them for as long as the service lasts, without copying, reselling or modifying them.
The processes you describe for your restaurant remain yours. We may use what we learn, in aggregated and anonymous form, to improve the product.
Confidentiality
Each party protects the other's confidential information and uses it only for the relationship between them.
Liability
Luke is provided as is and with professional care. We are not liable for indirect damages, lost profits or data loss caused by third-party systems.
Our total liability to a customer is limited to the amount paid for the service in the twelve months before the event giving rise to it, except in cases of willful misconduct or where the law does not allow such a limit.
Governing law and jurisdiction
These terms are governed by the laws of Chile. Any dispute is resolved before the courts of Santiago, unless the contract with the customer provides otherwise.
Changes to these terms
We may update these terms. We publish the new version here with its date and give customers advance notice when a change affects them.
